Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using any services provided by The Wellness Initiative Counseling and Consulting, PLLC (“us”, “we”, or “our”).

1. Scope of Services
We provide mental health counseling and consulting services, including but not limited to individual therapy, family therapy, and clinical consultations, either in person or virtually.
2. Eligibility
You must be at least 18 years old or have parental/legal guardian consent to use our services. By agreeing to these Terms, you warrant that you have the legal capacity to enter into a binding agreement.
3. Confidentiality and Privacy
We are committed to protecting your privacy in accordance with our Privacy Policy, which details how your personal health information is collected, used, and protected. This includes:
- HIPAA-compliant use of AI for note-taking.
- Limited sharing of data as required by law.
- Your rights to access and control your health information.
4. Use of Artificial Intelligence (AI)
We use secure AI tools to assist in session documentation. AI processing is temporary and confidential. Data is not shared externally and is deleted once notes are finalized.
5. Fees and Payment
You agree to pay all fees associated with the services provided. Insurance claims may be submitted on your behalf, and you are responsible for any remaining balances not covered by your insurer.
6. Appointment Scheduling and Cancellations
Scheduled appointments must be canceled with at least 24-hour notice. Missed appointments or late cancellations may incur a fee, unless excused due to emergencies or special circumstances.
7. Limitation of Liability
We are not liable for any damages resulting from your use of or inability to use our services, except as required by applicable law. We do not guarantee outcomes from therapeutic services.
8. Termination of Services
We reserve the right to terminate or refuse services if:
- There is a breach of these Terms.
- Safety concerns arise.
- Continued service is not clinically appropriate.
9. Changes to Terms
We may update these Terms at any time. Any modifications will take effect immediately upon being posted. Continued use of services after changes implies acceptance of the new Terms.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
